Recap of arguments in Kucana v. Holder

11/12/09: SCOTUSBlog presents a recap of the oral arguments that took place at the Supreme Court on Tuesday in Kucana v. Holder.  Kucana is challenging a provision of the Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) which stripped courts of jurisdiction to review any “decision or action of the Attorney General . . . the authority for which is specified under this subchapter to be in the discretion of” the Attorney General."

Holder, which challenges the constitutionality of a provision of the Illegal Immigration Reform and Immigrant Responsibilty Act (8 U.S.C. § 1252(a)(2)(B)) that "stripped courts of jurisdiction to review any “decision or action of the Attorney General . . . the authority for which is specified under this subchapter to be in the discretion of” the Attorney General."
